Handpicked Terms and Conditions

These Terms & Conditions ("Terms") govern your access to and use of handpicked.you (the "Site") and the Handpicked bouquet-creation service (the "Service"). By using the Service, you agree to these Terms.
1. Who we are
The Service is operated by TERA POWER LLC, a New York limited liability company ("TERA POWER," "we," "us," "our"). We may also operate under the DBAs Handpicked and MYOBERRY.

2. Eligibility and children
2.1 Anonymous use allowed; accounts are 18+.
The Service is available for anonymous use (no account required) so users can create and share bouquets as images.
Accounts (including access to any paid flowers) are intended only for users who confirm they are 18 years or older. If you are under 18, you may still use the Service anonymously, but you may not create an account or purchase paid content.
2.2 If we learn you are under 18 and have an account.
If we learn that an account belongs to a user under 18, we may suspend or terminate the account and delete or de-identify associated account data, to the extent permitted and required by law.
3. The Service (what it does)
Handpicked lets you create digital flower bouquets on a canvas and share/export the result as an image file.
We may add or change features over time (see Section 14).
Current behavior
- Bouquets are created in the interface and can be exported/downloaded as an image and shared using your device's native sharing tools.
- We do not host your exported bouquet image for public viewing (no public gallery; no public bouquet URL created by the Service).
4. Accounts (if/when you create one)
4.1 Account creation.
To create an account you must: be 18+ (or otherwise eligible under Section 2), provide an email address, and complete email verification.
4.2 Account security.
You are responsible for maintaining the confidentiality of your login credentials and for activity under your account.
4.3 Account deletion.
An automated self-service deletion tool is not available yet. You may request deletion by emailing support@myoberry.com.
5. Paid flowers and future payments (not yet launched)
We may offer optional paid content such as one-time purchase flower packs that unlock additional digital flower assets ("Paid Flowers").
Not yet launched: Payment processing provider, pricing, taxes, and checkout flows may change. Before launch (or material changes), we will update these Terms and/or provide in-product notice.
5.1 No refunds (digital goods).
To the fullest extent permitted by law, all sales are final and no refunds will be provided for digital content once unlocked or delivered, except where required by law.
6. Intellectual property
6.1 Our IP.
The Service, including the software, design, and flower assets (including any free and paid flowers), are owned by TERA POWER or its licensors and are protected by intellectual property laws.
6.2 Your bouquet output.
When you create a bouquet, you can export an image of the bouquet. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use the exported bouquet image:
- for personal use (including sharing with friends and posting on social media),
- for commercial content use (e.g., use in videos, podcasts, and promotional content),
but not to sell the exported image as a standalone product (e.g., selling the image file itself), unless we expressly permit it in writing.
6.3 No asset extraction / redistribution.
You may not:
- copy, extract, or redistribute individual flower assets,
- reverse engineer the Service or attempt to derive source code,
- use the Service to build a competing library of flower assets, or
- bypass entitlements or paywalls.
6.4 Watermark.
Exported bouquets may include a watermark. You agree not to remove, obscure, or alter watermarks or attribution.
7. Acceptable use
You agree not to misuse the Service. You must not:
- violate any law or infringe rights of others,
- attempt to gain unauthorized access to the Service or its systems,
- interfere with or disrupt the Service (including by introducing malware),
- scrape or harvest content or data from the Service without permission,
- circumvent access controls, entitlements, or security measures,
- use the Service for harassment, hate, sexual exploitation (including minors), threats, fraud/impersonation, doxxing, or illegal activity.
8. Bots and automated access
Automated access ("bots") is allowed only if it:
- respects robots.txt,
- uses reasonable rate limits,
- does not interfere with normal operation, and
- is not used for scraping, competitive intelligence, or circumventing restrictions.
We may block or throttle automated access at any time.
9. Rate limiting; suspension; termination
We may limit, suspend, or terminate your access to the Service (including accounts) at any time if we reasonably believe you have violated these Terms, abused the Service, or pose risk to users or systems. For severe abuse, we may suspend immediately without prior notice. We do not offer an appeal process at this time.
10. Third-party services
The Service uses third-party providers (e.g., hosting, authentication, analytics, email). Your use of those services may be subject to their terms. We are not responsible for third-party services outside our control.
11. Feedback
If you provide feedback or suggestions, you grant us the right to use them without restriction or compensation.
12. Disclaimers
The Service is provided "AS IS" and "AS AVAILABLE." We do not make warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
13. Limitation of liability
To the fullest extent permitted by law:
- We are not liable for indirect, incidental, special, consequential, or punitive damages.
- Our total liability arising out of or relating to the Service will not exceed the amount you paid to us for the Service in the 12 months before the event giving rise to the claim (or $0 if you have not paid anything).
Some jurisdictions do not allow certain limitations; in that case, limitations apply to the maximum extent permitted.
14. Changes to the Service or Terms
We may modify the Service and these Terms. If we make material changes, we will provide notice (for example, by email to account holders and updating the policy page). You indicated a target notice period of about 1 month for material changes when feasible, but urgent changes may be effective sooner.
15. Governing law and venue
These Terms are governed by the laws of the State of New York, without regard to conflicts of law principles. Any dispute must be brought in the state or federal courts located in New York, and you consent to their jurisdiction.
16. General IP complaints (copyright / trademark)
If you believe content in the Service infringes your intellectual property rights, email support@myoberry.com with: your name and contact information, identification of the work/right you believe is infringed, what you want removed or changed, an explanation of your claim, and any supporting materials.
We may request additional information before taking action.
